Terms of Use

Before using the Fund's Website or making charitable contributions through the Website, please read these Terms of Use carefully.

By using the Website, you confirm that you have read these Terms of Use, understand their content and undertake to comply with them in full. If you do not agree to these Terms, please do not use the Website. If you have any questions or comments about these Terms, please contact us at mail@vasylevskyfund.org.

 

Terms of Use of the Website of the Charitable Organisation "Charity Fund Name of Michael Vasylevsky" https://www.vasylevskyfund.org/ (hereinafter referred to as the Website)

 

1.         These Terms are a contract of joining within the meaning of Article 633 of the Civil Code of Ukraine between the charitable organisation "Charity Fund Name of Michael Vasylevsky" (USREOU 44317490; Ukraine, 02081, Kyiv, 23-A Urlivska St., Apartment 171) (hereinafter referred to as the Fund) and the users of the Website, who by using the Website by such conclusive actions confirm that they undertake to comply with these Terms.

2.         All the rules published on the Website, including the Privacy Policy, together with these Terms constitute a single agreement between the Website user and the Fund. This agreement governs the use of the Website and the collection of charitable contributions through the Website.

3.         By using the Website, the user confirms he/she:

1) has the necessary level of civil capacity in accordance with the laws of his/her country, which allows him/her to enter into this agreement.

2) the use of the Website does not contradict the legislation of the user's country.

3) will comply with these Terms and all relevant legal requirements.

4) agrees with the Fund's independent choice of the direction of use of funds and other property received from the user.

4.         By providing the Fund with his/her e-mail address through the Website, the user confirms that he/she understands and agrees that the Fund may send messages to such e-mail, including:

1) information about updates to the Terms and Conditions

2) information about updates to the Website;

3) information and materials related to charitable contributions and their use.

5.         The Fund does not belong to any political party or commercial organisation. All documents of the Fund are available on the Website in the section "About the Fund". The Fund is financed by monetary contributions from individuals and legal entities in the amount determined by them independently, the transfer of which is a charitable donation in accordance with Article 6 of the Law of Ukraine "On Charitable Activities and Charitable Organisations" and is not subject to further refund.

6.         The Website is designed to assist the Fund in collecting charitable contributions or other aid, as well as reporting on the Fund's activities. The funds raised through the Website are used to finance activities that meet the statutory goals and activities of the Fund. Assistance to the Fund may be provided through charitable contributions, free transfer of other property (persons providing such assistance are hereinafter referred to as Donors), or through volunteer activities (persons providing such assistance are hereinafter referred to as Volunteers). The website is also intended to collect information about those in need of assistance (hereinafter referred to as Beneficiaries).

7.         The Website is used to raise funds and other property for the following activities of the Fund:

1) assistance to terminally ill people living in the Kyiv Region.

2) assistance in the restoration of facilities in the Kyiv Region damaged as a result of Russian aggression.

3) assistance to healthcare and educational institutions in the Kyiv Region.

4) assistance to the Armed Forces of Ukraine.

8.         Through the Website (the " Donate " link), the user has the opportunity to make charitable contributions to support the Fund, which uses these funds to implement projects in the above areas. Payments through the Website are provided by a payment service provider that is not under the control of the Fund. The Fund is not responsible for the content and functionality that may be offered on the website of the payment service provider, as well as for any losses, damages, or other monetary obligations arising from the use of the payment service provider's services. When going to the website of the payment service provider to make a donation, the Donor must read and comply with the terms of use, privacy policy, and other policies established by the provider. The Fund is not responsible for the processing of personal data, including payment information requested by the payment service provider.

Payment of the charitable contribution is made in accordance with the terms and conditions of the Donor's bank. The Fund has no information about the terms of banking transactions, including the amount of commission for money transfers, currency exchange transactions, etc.

9.         Reports on the use of charitable contributions are available on the Website. The Fund regularly publishes these reports on its social media pages and annually submits reports on the use of the non-profit organisation's income (profits) to the State Tax Service. These reports are also available on the Website for review.

10.       Persons who have the relevant skills, knowledge, and free time and wish to help the Fund may become volunteers. Persons wishing to become a volunteer of the Fund should send an e-mail to mail@vasylevskyfund.org and provide contact details. The Foundation's coordinator will contact the candidate and help find a way to help the Fund. The Fund may conclude an appropriate volunteer agreement at the request of the volunteer. Persons under the age of 18 must obtain written consent from their parents or legal guardians for their volunteer activities in favour of the Fund.

 

11.       In order to receive aid, the Beneficiary must apply to the Fund and provide documents with all the necessary information according to the list provided by the Fund's coordinator. At its discretion, the Fund may provide or refuse to provide aid without explaining the reasons for the refusal. Before applying to the Fund, the Beneficiary shall carefully read the Privacy Policy, which contains information on the processing of the provided personal data and the rights that the person has in this regard.

12.       The Fund owns the Website and controls its content. The content contained on the Website, such as text, images, audio and video recordings, belongs to the Fund or is posted with the permission of the owners, and the intellectual property rights to the content belong to the Fund. Access to and viewing of any content posted on or through the Website is possible solely for personal non-commercial purposes. Any element of the content may be used only with the written consent of the Fund or the respective owners. Modification and creation of derivative pieces using the content without the written permission of the Fund are not allowed.

13.       The Fund shall not be liable for any damages (including the costs of legal defence and consultations of other experts) arising from the use of the Website for any unlawful or unauthorised purposes.

14.       These Terms are an agreement governed by the laws of Ukraine. Any disputes arising from the use of the Website shall be resolved by the courts of Ukraine. The Terms are written and interpreted in accordance with the laws of Ukraine.

15.       The Fund has the right to amend these Terms at any time. The amended Terms and Conditions shall come into force and apply from the date of such amendment.

16.       The invalidity of any of the provisions of these Terms shall not affect the validity of other provisions of these Terms, which shall remain in force and subject to execution.

17.       The transfer by the Fund of its rights and obligations under these Terms to a third party shall not result in the termination of this Agreement for the User.
